Buyer Terms of Service

Effective Date: October 13, 2026

These Terms of Service ("Terms") are a legally binding contract between you and US Collectibles NE LLC, a Nebraska limited liability company (the "Company"). By accessing, creating an account, using or placing a bid on our website at https://uscollectiblesne.com/ (the "Platform"), you acknowledge that you have read and agreed to these Terms of Service. If you do not agree to these Terms, you may not use or access the Platform. You are not permitted to access the Platform if your account has been suspended or terminated by us for any reason. By accessing the Platform, you acknowledge and accept our Privacy Policy (available at uscollectiblesne.com/privacy).

1. Account Registration

1.1 You must be at least 18 years or older to create an account. If you are under the age of 18, you are prohibited from accessing or using the Platform.

1.2 You must provide accurate, current information during registration, including a valid email address. You represent and warrant that your account information is accurate.

1.3 You are solely responsible for maintaining the confidentiality of your account credentials. You are solely responsible for all activity under your account, whether or not you authorized the activity. We will not be liable for any loss or damage of any kind arising from your failure to comply with these Terms.

1.4 The Company reserves the right to suspend or terminate accounts that violate these Terms and to refuse the use of the Platform.

1.5 Eligibility. Bidding and purchasing on the Platform are available only to buyers located in the United States. Items ship within the continental United States only (see Section 5.1).

2. Bidding

2.1 Binding Bids. All bids on the Platform are binding offers to purchase. By placing a bid, you agree to pay the bid amount plus the buyer premium and applicable shipping costs if you are the winning bidder.

2.2 Buyer Premium. A buyer premium of 10% of the hammer price (winning bid amount) is added to all purchases. The buyer premium is clearly displayed on the Platform before you place a bid.

2.3 Proxy Bidding. You may set a maximum bid. The system will then bid on your behalf incrementally up to your maximum bid. Your maximum bid is confidential.

2.4 Soft Close. A bid placed in the final 60 seconds of an auction extends the lot closing time by 30 seconds to prevent last-second sniping.

2.5 Bid Retraction. Submitted bids may not be retracted except in cases of clear error (for example, accidentally placing a bid of $1,000 instead of $100). Bid retraction requests must be made by email to our support address, info@uscollectiblesne.com, before the final hour of the auction. Decisions on bid retractions are granted at the Company's sole discretion.

2.6 Reserve Prices. Some items may have a reserve price. If the reserve on an item is not met, the item will not sell. Reserve prices are not disclosed to bidders on the Platform.

3. Payment

3.1 Purchases on the Platform are facilitated through a third-party service provider who we may provide with information regarding your payment method. You represent and warrant that such information is accurate and that you are authorized to use the payment method you submit. You are responsible for all taxes associated with any purchases you make through the Platform.

3.2 Auto-Charge Authorization (Two-Charge Model). By creating an account on the Platform and adding a card on file, you authorize the Company to automatically charge your payment method in the following two steps when you win an auction:

  • Charge 1 (at auction close): Your card will be charged the hammer price + buyer premium (10%) + applicable sales tax. Charge 1 will typically be processed within minutes of the auction closing.
  • Charge 2 (after packing the item for shipping): Your card will be charged the shipping cost + insurance (where applicable). Charge 2 will typically be processed when the item is ready to ship.

Both charges will be itemized on your purchase receipt. Your saved payment method is charged for both Charge 1 and Charge 2.

3.3 Card on File. You must maintain a valid payment method on file to bid. If your card is declined, you must provide an alternative payment method within 48 hours or your account will be suspended.

3.4 Payment Deadline. If you are a successful bidder and your payment is not received within 48 hours of the auction close, the Company may cancel the sale, relist the item, and suspend your account.

3.5 Currency. All prices and all payments are in United States Dollars (USD).

4. Sales Tax

4.1 Marketplace Facilitator. US Collectibles NE LLC operates as a marketplace facilitator and collects applicable sales tax as required by state law. Only buyers located in the United States may bid or purchase (see Section 1.5).

4.2 Tax Calculation. Sales tax is calculated based on the buyer's U.S. shipping address and is itemized separately on the purchase receipt. Sales tax is collected on the total purchase amount (hammer price + buyer premium + shipping).

4.3 Tax Rates. Tax rates and applicability vary by state. Some item categories may be exempt from sales tax in certain jurisdictions.

5. Shipping and Delivery

5.1 Continental US Only. The Company ships within the continental United States only (48 contiguous states).

5.2 Shipping Costs. Shipping costs are calculated based on item weight, dimensions, and destination at the buyer's expense. Shipping costs are billed via Charge 2 (see Section 3.2) once the item is packed for shipping.

5.3 Carriers. Items are shipped via USPS, UPS, or other commercial carriers at the Company's discretion.

5.4 Insurance. Items valued over $500 are shipped with insurance and signature confirmation. Items under $500 may be shipped without insurance unless the buyer requests it.

5.5 Delivery Timeline. The Company will typically ship items within 5 business days of payment confirmation. Delivery times depend on the carrier and destination.

5.6 Risk of Loss and Cancellation. Risk of loss passes to the buyer upon delivery to the shipping carrier. The Company reserves the right to cancel any sale for any reason.

5.7 Local Pickup. Local pickup is not available to buyers. All items are shipped.

6. Returns and Disputes

6.1 "Not as Described" Claims. If an item is materially different from its auction listing description, the buyer may file a dispute within 7 days of delivery. See our Return and Refund Policy (uscollectiblesne.com/refunds) for details.

6.2 All Sales Final. Except for "not as described" claims that are validated by the Company, all sales are final and you cannot cancel or return any purchase. Buyer's remorse is not a valid reason for return.

6.3 Dispute Process. Disputes are handled through the Platform's messaging system. The Company will review disputes within 5 business days and issue a resolution in its sole discretion.

6.4 Chargebacks. Filing a credit card chargeback without first using the Platform's dispute process may result in permanent account suspension.

6.5 Item Descriptions and AI-Assisted Cataloging.

AI-Assisted Listings: Read Before Bidding

Many item titles, descriptions, categories, condition notes, and suggested values on this Platform are drafted by artificial intelligence (computer vision + language models) and then reviewed by our operator before publishing. AI tools can miss details, misread mintmarks or signatures, misjudge condition, or state values that do not reflect a buyer's specific market. We do not warrant the AI-assisted portion of any listing. Photographs are the binding representation of the item. If you cannot confidently bid from the photographs alone, we recommend you request additional images, contact us with questions, or obtain an independent appraisal before committing.

By placing a bid you confirm that you have read this disclosure and accept the item subject to the photographs and the operator-reviewed listing copy, not the AI-drafted source text alone.

In-house condition grades are subjective assessments and are not professional certifications. Items with third-party certification (PCGS, NGC, PSA, BGS, SGC, CGC) display the certifying service's grade in place of our in-house assessment.

Before placing a bid or purchase, buyers are encouraged to review all photographs, ask questions through the Platform, request additional images, or obtain an independent appraisal. Bids placed through the Platform constitute the buyer's acceptance of the item as pictured and described, subject only to the "not as described" claim window in Section 6.1.

7. Prohibited Conduct

You are solely responsible for your conduct while accessing or using the Platform, including without limitation, you agree not to:

  • Place bids you do not intend to honor
  • Use the Platform to launder money, conduct fraudulent transactions or in violation of the laws in any jurisdiction
  • Create multiple accounts to manipulate bidding
  • Interfere, disrupt or attempt to negatively affect the operation of the Platform
  • Harass or engage in conduct that is objectionable to other users, consignors, Company staff or any third parties

8. Intellectual Property

8.1 All content on the Platform (text, images, logos, software) is owned by US Collectibles NE LLC or its licensors and is protected under applicable law.

8.2 Item photographs and descriptions on the Platform are created by the Company for auction purposes only. Buyers may not reproduce or redistribute auction content or any other content on the Platform without the Company's permission.

8.3 You agree not to use the Platform for any unauthorized or illegal purposes, not to reverse engineer any aspect of the Platform, not to copy, scrape or download any data or content on the Platform and not to train artificial intelligence or machine learning models on the Platform without the Company's express written permission.

9. Limitation of Liability

9.1 The Company acts as an intermediary between consignors and buyers. The Company does not own the items consigned on the Platform and makes no warranties regarding items beyond the descriptions provided in auction listings. The Company's Platform and services are provided "AS IS" without warranty of any kind either express or implied including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose, title, non-infringement, security or accuracy, and the Company does not represent or warrant that the Platform or the service is accurate, complete, reliable, current or error free, or that the quality of any items, services, information, or other material purchased or obtained through the Platform will meet your expectations.

9.2 The Company's total liability to any buyer is limited to the amount paid by that buyer for the specific item in dispute.

9.3 The Company shall not be liable for any indirect, incidental, or consequential damages in any way arising under or in connection with these Terms, the Platform or the Company's services.

9.4 The Company is not liable for delays or failures caused by events beyond its reasonable control.

10. Push Notifications and Communications

10.1 Push Notifications. The Platform offers optional browser-based push notifications for outbid alerts and auction-ending reminders. You consent to receive these notifications when you click "Enable push notifications" in your account settings. You can disable them at any time through your account settings or your browser's notification controls.

10.2 Email and SMS. The Company sends transactional email (via Resend) and may send SMS messages (via Twilio) for outbid notifications, payment confirmations, shipping updates, and account-related communications. You may not opt out of transactional communications related to active transactions.

11. Multi-Role Accounts

11.1 Single Account, Multiple Roles. You may not have more than one active account on our Platform. A single user account may hold both the buyer and consignor roles. You may add a role to your account at any time through the Platform's account settings.

11.2 Role-Specific Terms. When acting as a consignor on the Platform, you are additionally subject to the Company's Consignment Agreement. When acting as a bidder or buyer on the Platform, you are subject to these Buyer Terms of Service. Switching the active role on your account does not change which agreements apply to your respective activities.

12. General Provisions

12.1 Governing Law. These Terms are governed by the laws of the State of Nebraska.

12.2 Dispute Resolution. Disputes shall be resolved in the courts of Douglas County, Nebraska.

12.3 Amendments. The Company may update these Terms at any time. Continued use of the Platform after notice of changes constitutes acceptance of the updated Terms.

12.4 Severability. If any provision of the Terms is found unenforceable, the remaining provisions remain in full force and effect.
